Terms - Nursing Success by Choosing Nursing

TERMS OF USE

Last Updated: September 16, 2026

Welcome to Choosing Nursing.
These Terms of Use (“Terms”) govern your access to and use of the Choosing Nursing website located at choosingnursing.net, our online stores, courses, memberships, communities, educational programs, digital products, physical products, question banks, tutoring or coaching services, mobile or web-based resources, emails, content, and other products and services that reference or link to these Terms (collectively, the “Services”).
The Services are operated by Choosing Nursing LLC (“Choosing Nursing,” “Company,” “we,” “us,” or “our”).
Please read these Terms carefully before accessing or purchasing our Services.
By accessing our website, creating an account, purchasing a product or service, enrolling in a program, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies or terms applicable to a particular product or service.
If you do not agree to these Terms, please do not use the Services.

1. EDUCATIONAL PURPOSE

Choosing Nursing provides educational information, resources, products, courses, study materials, and related services for nursing students, nursing graduates, nurses, aspiring healthcare professionals, healthcare professionals, entrepreneurs, and other members of the public.
Our content is provided for educational and informational purposes only.
Nothing provided through Choosing Nursing constitutes medical, nursing, legal, financial, accounting, tax, investment, employment, or other individualized professional advice.
Although some Choosing Nursing content may be created or presented by licensed healthcare professionals, accessing our content does not establish a nurse-patient, healthcare provider-patient, attorney-client, financial advisor-client, or other professional relationship.
You are responsible for evaluating information and making your own educational, professional, financial, business, healthcare, and career decisions.

2. NCLEX AND EXAM PREPARATION DISCLAIMER

Choosing Nursing provides educational resources that may assist individuals preparing for examinations such as the NCLEX-RN, NCLEX-PN, TEAS, nursing-school examinations, and other educational or professional examinations.

We do not guarantee that purchasing, accessing, completing, or using any Choosing Nursing product or service will result in passing the NCLEX or any other examination.

Examination performance depends on numerous factors outside our control, including but not limited to:
Customers remain solely responsible for determining when they are prepared to take an examination.
Choosing Nursing is not affiliated with, endorsed by, or sponsored by the National Council of State Boards of Nursing (“NCSBN”), Pearson VUE, ATI, individual state boards of nursing, or any other examination administrator unless we expressly state otherwise.
References to third-party examinations, trademarks, organizations, or testing programs are for identification and educational purposes.

3. NO GUARANTEE OF LICENSURE, EMPLOYMENT, OR CAREER RESULTS

Completing or purchasing a Choosing Nursing program does not guarantee:
Licensing requirements vary by jurisdiction and may change.
You are responsible for verifying current requirements with the applicable board of nursing, licensing agency, school, employer, certification body, or other relevant organization.

4. BUSINESS, FINANCIAL, AND INCOME DISCLAIMER

Choosing Nursing may publish educational content concerning entrepreneurship, social media, content creation, affiliate marketing, digital products, e-commerce, monetization, nursing businesses, career opportunities, personal finance, saving, investing, or other methods of earning or managing money.
Such information is educational only.

We do not guarantee that you will earn any particular amount of money—or any money at all—as a result of using our information, strategies, programs, products, recommendations, or services.

Business and financial results vary substantially between individuals.
Examples of revenue, sales, business growth, social-media performance, earnings, savings, investment performance, or other financial results should not be interpreted as promises, guarantees, or representations of results that you will achieve.
You are responsible for your own business and financial decisions and should consult an appropriately qualified professional when necessary.

5. TESTIMONIALS AND SUCCESS STORIES

Our websites, advertisements, emails, social-media accounts, products, and Services may feature testimonials, reviews, success stories, examination results, customer experiences, screenshots, or other statements from customers or members of our community.
These examples describe individual experiences.

Testimonials and success stories are not guarantees that you will achieve the same or similar results.

Your results may differ significantly.
Where we discuss a student’s examination success, the student’s success should not be interpreted as establishing that Choosing Nursing was the sole cause of that outcome. Students may have used other resources, education, tutoring, courses, books, study methods, or preparation strategies.

6. PAST CUSTOMERS AND HISTORICAL PURCHASES

Purchasing a Choosing Nursing product or service does not create a perpetual obligation by Choosing Nursing to provide services, tutoring, coaching, customer support, updates, replacement products, new editions, continued platform access, or additional educational assistance indefinitely.

The benefits associated with a purchase are those described in the offer applicable at the time of that purchase, subject to applicable law.

For example, a person who purchased a course, tutoring service, membership, program, book, or other resource years ago is not automatically entitled to current versions of our programs, newly created products, additional tutoring, indefinite access, refunds, or continuing services unless those benefits were expressly included in the applicable purchase terms.
The fact that a customer has not yet passed an examination, obtained licensure, secured employment, earned income, or achieved another desired outcome does not by itself create an obligation for Choosing Nursing to provide additional services or issue a refund.
Nothing in this section eliminates rights that cannot legally be waived or any specific written guarantee that applied to a customer’s original purchase.

7. PRODUCT AND PROGRAM CHANGES

We continually improve and update our products and Services.
We may add, remove, replace, reorganize, update, or modify content, lessons, instructors, videos, downloads, questions, resources, features, communities, platforms, schedules, bonuses, or other elements of our Services.
A course or program may therefore look different over time.
Unless expressly promised as part of your specific purchase, purchasing a product does not guarantee that every feature, bonus, instructor, live component, platform, or resource available at one point in time will remain available permanently.
Material changes to prepaid or subscription Services will be handled subject to applicable law and any terms specifically applicable to those Services.

8. ACCESS PERIODS

Access periods vary by product.
Some products may provide:
The access period presented when you purchase a product governs your purchase unless otherwise required by law.
“Lifetime access”, when expressly offered, means access for as long as Choosing Nursing continues to offer and maintain that particular product or substantially equivalent access, rather than the lifetime of the purchaser, unless the applicable offer expressly states otherwise.

9. ACCOUNTS AND LOGIN CREDENTIALS

Certain Services require an account.
You agree to provide accurate information and maintain the confidentiality of your login credentials.
Your account is for your personal use only unless Choosing Nursing expressly authorizes another arrangement.
You may not:
We may suspend or terminate accounts when we reasonably believe unauthorized account sharing, fraud, piracy, abuse, or other violations of these Terms have occurred.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, the content provided through Choosing Nursing is owned by or licensed to Choosing Nursing and is protected by applicable copyright, trademark, and other intellectual-property laws.
This may include:
Your purchase grants you a limited, personal, non-exclusive, non-transferable license to use the purchased materials for your own personal educational use, unless a different license is expressly provided.
Purchasing a product does not transfer ownership of the intellectual property to you.

11. PROHIBITED USE OF OUR CONTENT

Unless you receive prior written authorization from Choosing Nursing, you may not:
We reserve the right to pursue available remedies for unauthorized copying, distribution, resale, piracy, or infringement.

12. ARTIFICIAL INTELLIGENCE AND DATASET USE

Except where expressly permitted in writing, you may not systematically scrape, download, reproduce, or use our paid or proprietary content to create, train, fine-tune, populate, benchmark, or commercially exploit an artificial-intelligence system, machine-learning model, question bank, dataset, educational platform, or competing product.
This restriction does not prohibit uses that cannot lawfully be restricted.

13. PRACTICE QUESTIONS AND EDUCATIONAL MATERIALS

Practice questions provided by Choosing Nursing are educational materials intended to assist with preparation and learning.
Unless expressly identified otherwise, they are not actual NCLEX questions and should not be interpreted as representing the exact questions that will appear on an examination.
Exam plans, standards, terminology, clinical guidance, and testing formats may change over time.
We make reasonable efforts to provide useful and accurate educational content but cannot guarantee that every item will remain current indefinitely.

14. CLINICAL AND MEDICAL INFORMATION

Clinical information provided by Choosing Nursing is intended for education and examination preparation.

It should not be used as a substitute for professional clinical judgment, employer policies, facility protocols, physician/provider orders, current evidence-based clinical references, or applicable standards of care.

Healthcare professionals and students are responsible for following applicable laws, professional standards, institutional policies, and supervision requirements.

Never delay or disregard appropriate medical care because of information provided through Choosing Nursing.

15. PURCHASES AND PAYMENTS

Prices are displayed before purchase and may change at any time for future purchases.

You agree to provide valid and accurate billing information and authorize us and our payment processors to charge the payment method you provide for purchases you authorize.

Applicable taxes, shipping charges, or other fees may be added where required and disclosed during checkout.

Promotional pricing, coupon codes, discounts, bonuses, and special offers may be available for limited periods.

A customer who purchases at one price is generally not entitled to a refund or credit merely because the product is later offered at a different price.

16. PAYMENT PLANS

Certain products may be offered through installment or payment plans.

A payment plan represents an agreement to pay the full purchase price through scheduled installments; it is not necessarily a month-to-month subscription that can be canceled after receiving access.

Unless the applicable offer expressly states otherwise, selecting a payment plan does not eliminate your responsibility for remaining installments merely because you stop using the product.

If a scheduled payment fails, we may suspend access while the account remains unpaid, subject to applicable law.

17. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

Some Services may be sold as subscriptions, memberships, continuous-service plans, or automatically renewing plans.

When a product automatically renews, the applicable checkout or enrollment page will disclose material terms of the recurring arrangement, including the billing frequency and price or method for determining the price, as required by applicable law.

By affirmatively enrolling in an automatically renewing Service, you authorize recurring charges according to the terms disclosed when you enroll.

You may cancel an automatically renewing Service using the cancellation method provided for that Service.

Cancellation generally prevents future renewal charges but does not necessarily entitle you to a refund for a billing period that has already begun, except where required by law or provided by the applicable refund policy.

We will provide notices, reminders, cancellation mechanisms, and other disclosures required by applicable automatic-renewal and consumer-protection laws.

18. CANCELLING SUBSCRIPTIONS

For subscriptions purchased online, we will provide an online method of cancellation as required by applicable law.

Additional cancellation methods may be available depending upon the product and platform used for enrollment.

Cancellation takes effect according to the terms presented for the applicable subscription.

After cancellation, you may retain access through the end of a paid billing period where applicable, after which access may terminate.

Deleting an app, ignoring billing notices, failing to use a Service, or abandoning an account does not by itself constitute cancellation.

19. REFUNDS

Refund eligibility varies by product.

The refund policy or guarantee specifically presented on the sales page, checkout page, order form, or written offer applicable to your purchase governs that purchase, subject to applicable law.

Some products may be non-refundable or final sale where legally permitted.

Other products may have a specific money-back guarantee with eligibility requirements and deadlines.

A customer’s dissatisfaction with an examination result, failure to pass an examination, failure to complete a program, lack of use, change of mind, or failure to achieve a desired business, financial, career, or educational outcome does not automatically create a right to a refund.

Where a specific product includes a guarantee, customers must satisfy the conditions and deadlines of that guarantee.

Nothing in these Terms limits refund, cancellation, warranty, or other consumer rights that cannot legally be waived.

20. DIGITAL PRODUCTS

Because downloadable digital products may be accessible immediately after purchase, certain digital-product sales may be final where permitted by law and where appropriately disclosed.

Digital purchases provide a license to use the materials under these Terms; they do not transfer copyright or ownership.

21. PHYSICAL PRODUCTS

Choosing Nursing may sell books, apparel, accessories, study materials, or other physical products.

Physical-product purchases may be subject to additional shipping, return, exchange, and fulfillment policies disclosed on the applicable store or product page.

Product images are intended to represent products accurately, but colors and appearance may vary depending on screens, manufacturing, printing, or other factors.

Shipping estimates are estimates rather than guarantees unless expressly stated otherwise.

22. THIRD-PARTY FULFILLMENT

Certain physical products may be manufactured, printed, shipped, or fulfilled by third-party providers.

Choosing Nursing is not responsible for delays or events beyond our reasonable control, although we will administer our obligations under applicable consumer laws and our stated policies.

23. THIRD-PARTY WEBSITES AND SERVICES

Our Services may link to or integrate with third-party websites, platforms, payment processors, applications, products, or services.

We do not control third-party services and are not responsible for their content, availability, security, privacy practices, policies, or actions.

Your use of a third-party service may be governed by that third party’s own terms and policies.

24. AFFILIATE LINKS AND COMMERCIAL RELATIONSHIPS

Some Choosing Nursing content may contain affiliate links.

If you purchase something through an affiliate link, Choosing Nursing may receive a commission or other compensation, potentially at no additional cost to you.

The existence of an affiliate relationship does not change your responsibility to evaluate whether a product or service is appropriate for you.

Sponsored content, paid partnerships, and other material relationships will be disclosed where required.

Additional information may be provided in our Disclaimer or Affiliate Disclosure.

25. USER COMMENTS, REVIEWS, AND COMMUNITY CONTENT

Certain Services may allow users to post comments, reviews, messages, questions, discussions, or other content.

You remain responsible for content you submit.

You agree not to post content that:

We may moderate or remove content when reasonably necessary to administer our Services or enforce these Terms.

26. PATIENT PRIVACY AND CONFIDENTIAL INFORMATION

Do not submit protected health information, personally identifiable patient information, confidential employer information, examination-security information, or other information you do not have permission to disclose.

Users who are healthcare professionals or students remain responsible for complying with HIPAA and other applicable privacy and confidentiality obligations.

27. REVIEWS, TESTIMONIALS, AND CONTENT YOU VOLUNTARILY SUBMIT

If you voluntarily submit a review, testimonial, comment, success story, photograph, video, or similar content to Choosing Nursing for publication or promotional use, you represent that the content is truthful to the best of your knowledge and that you have the right to submit it.

Where appropriate, we may separately request permission to use identifiable photographs, videos, recordings, or other personal media for promotional purposes.

Purchasing a product alone does not mean that you automatically grant Choosing Nursing unlimited rights to use your image, voice, or likeness in advertising.

28. LIVE CLASSES, TUTORING, COACHING, AND APPOINTMENTS

When live classes, tutoring, coaching, consultations, or appointments are offered, additional scheduling, attendance, cancellation, rescheduling, or no-show policies may apply.

Those policies will be disclosed with the applicable service.

Purchasing a course that does not expressly include live instruction does not entitle the purchaser to tutoring, coaching, live classes, or individual support.

29. RECORDINGS

Certain live educational sessions may be recorded.

When a session will be recorded, participants will be informed as appropriate.

Participants should avoid sharing private, confidential, patient-identifying, or other sensitive information during recorded sessions.

Any separate use of a participant’s identifiable image, voice, testimonial, or story for advertising or promotional purposes may require additional permission as appropriate.

30. EMAIL AND ELECTRONIC COMMUNICATIONS

When you provide your email address, make a purchase, or create an account, we may send transactional communications relating to your account, purchase, access, billing, security, or Services.

Where permitted and with any consent required by law, we may also send marketing communications.

You may unsubscribe from marketing emails using the unsubscribe link provided in those messages.

Unsubscribing from marketing communications may not prevent necessary transactional or account-related communications.

31. PROMOTIONS AND COUPON CODES

Promotional offers may be subject to additional terms.

Unless otherwise stated:

We may discontinue or modify promotions prospectively at any time.

32. ACCEPTABLE USE

You agree not to use our Services to:

33. SUSPENSION AND TERMINATION

We may suspend or terminate access to the Services when we reasonably determine that a user has materially violated these Terms, engaged in fraud, abused another user or staff member, infringed intellectual property, shared an account without authorization, engaged in piracy, created security risks, or failed to make required payments.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to resolve the issue.

Termination does not eliminate payment obligations that arose before termination.

34. AVAILABILITY OF SERVICES

We strive to keep our Services available but do not guarantee uninterrupted or error-free access.

Temporary interruptions may occur because of:

We may migrate content from one technology platform to another.

35. ACCURACY AND UPDATES

We make reasonable efforts to provide accurate and useful information.

However, nursing standards, examination policies, laws, clinical guidelines, prices, financial information, technology, social-media platforms, and other subjects discussed through our Services can change.

You should independently verify time-sensitive information with authoritative sources when making consequential decisions.

36. NO WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

CHOOSING NURSING DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT USE OF THE SERVICES WILL PRODUCE A PARTICULAR EDUCATIONAL, PROFESSIONAL, FINANCIAL, BUSINESS, OR EXAMINATION RESULT.

Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

37. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHOOSING NURSING AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHOOSING NURSING’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO CHOOSING NURSING FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE APPLICABLE TRANSACTION OR PERIOD.

These limitations do not apply where liability cannot lawfully be limited or excluded.

38. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Choosing Nursing harmless from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, your infringement of another person’s rights, or your material violation of these Terms.

This provision does not require you to indemnify Choosing Nursing for conduct for which indemnification cannot lawfully be required.

39. FORCE MAJEURE

Choosing Nursing will not be responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, severe weather, public-health emergencies, government actions, labor disruptions, internet outages, cyberattacks, utility failures, platform outages, or failures of third-party service providers.

40. PRIVACY

Your use of the Services is also subject to our Privacy Policy.

Please review our Privacy Policy to understand how personal information is collected, used, disclosed, and protected.

41. ADDITIONAL POLICIES

Certain products or Services may be governed by additional policies, disclosures, guarantees, order forms, or agreements.

These may include our:

Where product-specific written terms conflict with these general Terms regarding that particular product, the more specific terms generally control for that issue, subject to applicable law.

42. CHANGES TO THESE TERMS

We may revise these Terms from time to time to reflect changes in our Services, business practices, technology, or legal requirements.

When we make changes, we will update the “Last Updated” date.

Material changes will be communicated where required by applicable law.

Changes generally apply prospectively. We will not retroactively eliminate vested contractual or statutory rights where doing so would be prohibited by law.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.

43. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent another jurisdiction’s laws must apply and cannot lawfully be waived.

Nothing in these Terms deprives a consumer of mandatory protections provided by applicable law.

44. DISPUTE RESOLUTION

Before initiating formal legal proceedings, you and Choosing Nursing agree to make a good-faith effort to resolve disputes informally where reasonably possible.

A customer may begin this process by contacting Choosing Nursing and describing the issue and requested resolution.

Nothing in this provision prevents either party from seeking relief when immediate legal action is reasonably necessary or where applicable law provides otherwise.

Any additional arbitration, venue, jury-waiver, or class-action provisions should be separately reviewed and approved by qualified legal counsel before being added to these Terms.

45. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the extent legally permissible, and the remaining provisions will remain in effect.

46. NO WAIVER

Failure by Choosing Nursing to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.

47. ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our written consent.

Choosing Nursing may transfer these Terms as part of a merger, acquisition, corporate restructuring, sale of assets, or similar business transaction, subject to applicable law.

48. ENTIRE AGREEMENT

These Terms, together with any applicable product-specific terms and policies incorporated into them, constitute the agreement between you and Choosing Nursing regarding your use of the applicable Services and supersede prior general website terms concerning the same subject matter.

They do not eliminate specific contractual rights or obligations created by a prior purchase agreement, written guarantee, or other agreement that remains legally enforceable.

49. CONTACT US
